Terms of Service

These terms set clear expectations for website use and any products, installs, or services provided by Black Flag Command Center.

1) Acceptance

By using this site or engaging with Black Flag Command Center (“we,” “us,” or “our”), you agree to these Terms and our Privacy Policy.

2) Scope

We provide software, automation, and operational tooling that may include installed systems, configuration, training, support, and optional implementation services (the “Services”). Deliverables, availability, timelines, and scope vary by project and the written agreement governing your engagement.

3) Quotes, scope changes, and approvals

  • Quotes are based on the information available at the time of scoping and may rely on assumptions (integrations, access, data availability, compliance constraints).
  • If scope changes (new features, additional integrations, expanded content, new destinations), we may require a written change order or revised quote before work continues.
  • You agree to provide timely approvals and feedback when required to keep timelines intact.

4) Access and client responsibilities

  • You are responsible for providing accurate information and any necessary access (domains, DNS, email accounts, ad accounts, social/business profiles, hosting, data exports, credentials).
  • You represent that you have authorization to grant access and to connect any third-party accounts.
  • You are responsible for compliance obligations that apply to your business (industry rules, disclosures, consent requirements, record retention), unless otherwise agreed in writing.

5) Data, content, and usage

You are responsible for the content, data, and instructions you provide, including ensuring you have rights to use uploaded assets (logos, images, copy, lists). You agree not to submit unlawful, infringing, or malicious content or data.

6) Automation, AI, and outputs

  • Some workflows may generate drafts (copy, captions, ads, emails, metadata) using automation and/or AI. Outputs may require review and adjustment before publishing or sending.
  • You are responsible for final approval of content you publish or messages you send using the system.
  • We do not guarantee performance outcomes (rankings, leads, revenue) unless explicitly stated in a written agreement.

7) Third-party services and integrations

The system may connect to third-party services (email delivery, analytics, hosting, mapping, ad platforms, social platforms, payment processors). Those services are governed by their own terms and policies. We are not responsible for third-party outages, policy changes, account restrictions, or platform enforcement actions.

8) Billing and payment

  • Payment is due as stated in your invoice, order form, or written agreement.
  • Certain third-party fees (hosting, sending infrastructure, API usage, platform spend) may be billed separately and are your responsibility unless otherwise agreed in writing.
  • Past-due balances may result in paused work or suspended support until resolved.

9) Support and maintenance

Support terms (channels, hours, response targets, included maintenance) may vary by plan or written agreement. If support is not included, it may be available as an add-on.

10) Website use

You agree not to misuse the website or services (no unauthorized access, scraping, interfering with operation, or introducing malicious code). Site content is provided “as is” for general information and may change without notice.

11) Disclaimers

Except as expressly stated in a written agreement, we disclaim warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law. Your rights may vary by jurisdiction.

12) Limitation of liability

To the fullest extent permitted by law, Black Flag Command Center will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the site or Services.

13) Indemnification

You agree to indemnify and hold Black Flag Command Center harmless from claims arising out of your misuse of the site, violation of these Terms, or violation of laws/regulations related to your content, data, or business operations.

14) Governing law

These Terms are governed by the laws of the jurisdiction specified in your written agreement, or if none, the laws of the provider’s principal place of business, without regard to conflict of laws principles.

15) Changes to these Terms

We may update these Terms as the Services evolve. We’ll post the updated effective date at the top of this page. Continued use of the site constitutes acceptance of the changes.
